Policy Resolution 99-3 Vehicle Permits


Whereas, Article III, Section 5 of the Bylaws assigns the Board of Directors with "…all the powers and duties necessary for the administration of the affairs of the Condominium…"; and

Whereas, Article III, Section 5 (f) of the Bylaws allows the Board of Directors to make and amend "rules and regulations respecting the use and enjoyment of the Condominium…"; and

Whereas, Article VI, Section 4 (f) of the Bylaws states that parking spaces shall be used by unit owners for self service parking; and

Whereas, the Board of Directors has determined that persons not having business within the condominium community should not park their vehicles within the community;

Now, Therefore let it be known that, the Board of Directors does hereby adopt the following policy:

  1. Permits shall be renewed annually.
  2. Permits (resident decals and visitor cards) shall only be issued to a unit owner residing on the property with a copy of his/her settlement sheet on file, or to a tenant with a current lease on file with the Managing Agent ("the Agent").
  3. Permits shall not be issued to any unit in arrears of assessments due the Heatherlea of Arlington, A Condominium Unit Owners Association ("The Association").
  4. The Agent shall process all permit applications to ensure eligibility of applicants and shall issue permits on behalf of the Board in accordance with the terms of this resolution. Applications will include a copy of the current vehicle registration, and (for tenants) a current copy of the lease agreement. Once processed, permit applications shall be retained by the Agent and be subject to review by the Board.
  5. All vehicles parked on condominium property must have a permit designated for parking purposes.
  6. Two (2) visitor cards and a maximum of two (2) resident permits shall be issued per unit. Residents will be given one permit, per vehicle, up to the maximum, that has current registration and is in operating condition, as defined by the Virginia Division of Motor Vehicles.
  7. Resident permits shall be displayed only on those vehicles listed on the permit application and which are owned or operated by bona fide residents. Permits shall be placed in the lower left hand corner of the inside of the vehicle's rear windshield, and shall be clearly visible from the outside of the vehicle.
  8. Visitor cards shall only be displayed on those vehicles temporarily parked on the Condominium property and owned or operated by bona fide guests of residents. Cards shall be placed around the rear view mirror of the vehicle's front windshield, and shall be clearly visible from the outside of the vehicle.
  9. Application for replacement of permits resulting from loss, theft, or damage must be submitted in writing to the Agent. Replacement permits shall be subject to a ten dollar ($10) replacement fee per permit.
  10. Permits issued under the terms of this resolution shall remain valid until rendered obsolete by the Board of Directors, or the next annual renewal.
  11. Any vehicle that does not display a permit or pass as described above is subject to being removed from the parking area at the owners risk and expense.
  12. These regulations and those outlined in the Bylaws may be enforced by towing 24 hours a day, 7 days a week. Towing will be performed by an independent contractor who will adhere to the requirements set forth in the Arlington County Code and these parking regulations. The Association is not responsible for damage to vehicles arising from towing. All towing is performed at the sole risk and expense of the vehicle owner.
